Subsoil users are fined
The enterprise was fined in the amount of 65 MCI for overfulfilment of the plan. Entrepreneurs are indignant in Almaty region: companies are fined for overfulfilling the volume of mining of crushed stone. According to entrepreneurs, Article 365 in the Code "On Administrative Offenses" may lead to bankruptcy. At the meeting in the Chamber of Entrepreneurs with the participation of state bodies and the Prosecutor's Office, the Chairman of the Board of LLP "Kapshagayimmontazh" Dilmurat Kuziev spoke about the problems faced by enterprises and subsoil users in general. LLP "Crushing and sorting complex” was put into operation in June 2015. In 2016, we completed the production of crushed stone in the volume of 24,000 m3 with an annual plan of 10,000 m3. For all this time, the money earned from the sale of rubble went to workers' wages and taxes. The cost of realized rubble is very low, it was sold almost at cost. To date, due to the serious economic situation, it is impossible to plan a certain volume of production. Now, Taldykorgan Regional Inspectorate of Geology and Subsoil Use fined us in the amount of 65 MCI for this overfulfilment of the plan", - Kuziev noted. By law, businesses can’t change the approved production plan. In case of non-fulfillment or overfulfillment, they will be punished for "failure" to meet the planned volumes. Therefore, at the moment, this article has become an administrative barrier for subsoil users. In October 2016, the enterprise with an official letter addressed to the management of entrepreneurship and industrial-innovative development a request to increase the production of crushed stone to 23,000 m3 per year. Then at one of the meetings with the deputy akim of the region it was decided to send a commission to study the situation. However, this issue has not yet been resolved. According to Article 365 of the Code, for violation of the rules for conducting subsoil use operations, as well as the terms of subsoil use contracts, a fine is imposed on small businesses or non-profit organizations at a rate of 65 MCI, on medium-sized businesses - at a rate of 100, on subjects of large entrepreneurship - at a rate of 150 MCI . After the discussions, the sides made their suggestions and recommendations on how to resolve the issue. By all accounts, the planning of the production volume should go to the notification character, that is, the businessman will have the opportunity to change the plan of the enterprise. In addition, to solve systemic issues of the industry, the Association of Non-Producers of Almaty Region will be established soon.
